Terms of Service

p42ern.ai analyzes drafts of messages you submit and returns scores across five dimensions (Tone, Clarity, Confidence, Empathy, Effectiveness), along with tone rewrites, an AI coach ("Sage"), and a conversation simulator. Analysis is performed by a third-party AI model (Anthropic's Claude) processing the text you submit.

The Service provides communication feedback for informational purposes only. It is not professional, legal, medical, psychological, or relationship counseling advice, and it should not be relied on as a substitute for judgment in high-stakes situations. You are solely responsible for any message you send, and for evaluating whether the Service's output is appropriate for your circumstances.

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 16 years old to use the Service. Notify us promptly if you suspect unauthorized use of your account.

New accounts receive a time-limited trial with full access to evaluate the Service. After the trial ends, continued access requires an active paid subscription (Basic or Pro) with a valid payment method on file. If no payment method is added, access to metered features is paused until you subscribe.

Subscriptions are billed in advance on a monthly or annual basis and renew automatically until canceled. Payments are processed by Stripe; we do not store your card details. You can manage, switch, or cancel your subscription at any time from Settings, which opens Stripe's secure billing portal. Cancellation stops future renewals; it does not retroactively refund the current billing period unless required by law.

Plan limits, features, and pricing may change. We will make reasonable efforts to notify active subscribers of material changes to their plan before they take effect.

You agree not to use the Service to:

• Submit content that is unlawful, harassing, or intended to harm another person.
• Attempt to circumvent usage limits, security controls, or authentication.
• Reverse engineer, scrape, or use automated means to extract the Service's underlying prompts, models, or data beyond normal use of the product.
• Resell or provide the Service to third parties without our written consent.
• Upload content you do not have the right to share, or that infringes another party's intellectual property or privacy rights.

We may suspend or terminate accounts that violate these Terms, misuse the Service, or place undue load on it (for example, abusive automated requests).

You retain ownership of the drafts and messages you submit ("Your Content"). You grant us a limited license to process Your Content, including sending it to our AI provider, solely to operate and improve the Service and as described in our Privacy Policy. You represent that you have the right to submit Your Content and that doing so does not violate any law or third party's rights.

Scores, rationale, rewrites, coach responses, and simulated replies are generated by an AI model and may be inaccurate, incomplete, or unsuitable for your situation. You should use your own judgment before acting on or sending anything based on the Service's output. We do not guarantee any particular outcome from using a rewrite or following the Service's suggestions.

The Service relies on third-party providers to operate, including Anthropic (AI processing), Supabase (authentication and data storage), Stripe (payment processing), Resend (transactional email), Cloudflare (privacy-focused website analytics), and Sentry (error monitoring). Your use of the Service is also subject to the extent those providers' own terms govern the processing they perform on our behalf.

The Service, including its design, brand, and underlying software, is owned by us or our licensors and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service, with notice where reasonably practicable.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant the accuracy, reliability, or completeness of any AI-generated output.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service, including any reliance on AI-generated output. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the jurisdiction in which p42ern operates, without regard to conflict-of-law principles, except where local law requires otherwise.
